These Terms of Service ("Terms") govern your access to and use of services provided by TopNam Academy LLC ("TopNam Academy," "we," "us," or "our"), including QA AutoTest Hub, QamiAI tools, and the AI AutoTest Live Workshop (together, the "Services").
By purchasing, enrolling in, accessing, or using any of the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Scope of Services
We provide educational software, AI-assisted interview preparation tools, and live training offers. Some terms apply to all Services, while some apply only to a specific offer you purchase, such as QA AutoTest Hub or the AI AutoTest Live Workshop.
2. Eligibility and Enrollment
- You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase or use the Services.
- Enrollment is for one individual only. Access is personal, non-transferable, and may not be shared.
- You agree to provide accurate information during checkout, enrollment, scheduling, and account registration.
- We may deny, suspend, or cancel enrollment if information is false, incomplete, or used for improper or competitive purposes.
3. Purchases, Access, and Workshop Delivery
- Unless stated otherwise at checkout, purchases are one-time charges, not recurring subscriptions.
- Payment is due in full at the time of purchase. Taxes and payment processing charges may apply.
- Access to purchased materials or workshop enrollment is confirmed only after successful payment.
- The AI AutoTest Live Workshop is delivered as live online sessions on scheduled dates and times. You are responsible for attending those sessions and maintaining the equipment, browser, audio, and internet access needed to join them.
- We may reasonably update workshop schedules, hosts, materials, delivery format, or supporting tools when needed to operate the workshop.
- If a payment is reversed, disputed, or charged back, we may suspend or revoke access to the affected Service.
4. Refund Policy
Refund eligibility depends on the specific Service purchased.
- QA AutoTest Hub: You may request a refund within 5 days of purchase only if you have used fewer than 80 AI credits.
- AI AutoTest Live Workshop: Refund requests are considered only after you attend the first live session and before the second session starts. If you do not attend the first live session, you are not eligible for a workshop refund.
- We may verify purchase records, product usage, and workshop attendance before approving a refund.
- Approved refunds are returned to the original payment method within a reasonable processing time.
To request a refund, email `support@qamiai.com` with your name, purchase email, purchase date, and a short explanation.
5. Accounts and Acceptable Use
- You are responsible for all activity under your account and for keeping your login credentials confidential.
- You may not share accounts, scrape content, attempt unauthorized access, overload our systems, or interfere with the Services.
- You may not use the Services for unlawful, abusive, harassing, fraudulent, or defamatory activity.
- You may not use our materials or AI tools to build or market a competing product, training, or service without written permission.
6. Live Workshop Rules
- You must behave respectfully during live sessions and follow host instructions about participation, chat, muting, timing, and session flow.
- Disruptive conduct, harassment, hate speech, spam, or repeated interruption of the workshop is prohibited.
- You may not record, copy, rebroadcast, or redistribute live workshop sessions without our prior written permission.
- We may remove a participant from a live session, or terminate access entirely, for conduct that harms the learning environment or violates these Terms.
7. AI Features and Content
- AI-generated outputs are provided for educational and practice purposes only.
- AI outputs may be incomplete, inaccurate, outdated, or not suited to your specific situation.
- Do not submit sensitive personal data, confidential employer information, payment information, or regulated data into AI fields, prompts, or workshop exercises.
- AI outputs are not legal, financial, medical, hiring, or professional advice, and they do not guarantee job outcomes.
8. Intellectual Property
All workshop materials, videos, prompts, templates, slides, recordings, software interfaces, branding, and written content made available through the Services are owned by TopNam Academy LLC or our licensors and are protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to use purchased materials for your own personal, non-commercial learning. You may not copy, resell, publish, distribute, or create derivative commercial works from our content without written permission.
9. Termination
We may suspend or terminate access to any Service if you violate these Terms, misuse the Services, reverse payment, abuse other participants, or create legal, security, or operational risk for us or others. If access is terminated for cause, you are not entitled to a refund unless required by law.
10. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, specific learning outcomes, certification, employment, promotion, or any other particular result.
11. Limitation of Liability
To the maximum extent permitted by law, TopNam Academy LLC and its affiliates, employees, contractors, and partners are not liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the Services.
Our total aggregate liability for any claim arising out of or related to the Services or these Terms will not exceed US $50.
12. Disputes, Changes, and Contact
If you have a dispute, contact us first at `support@qamiai.com` so we can try to resolve it informally. If a dispute cannot be resolved informally, it will be governed by Nevada law and handled under the arbitration and class action waiver terms that apply to these Services.
We may update these Terms from time to time. Material updates will be posted on our site or sent by email when appropriate. Your continued use of the Services after an update takes effect means you accept the revised Terms.
